Knowing that CBD is derived from cannabis is often a source of curiosity and confusion for those investigating the potential benefits. For many people, the word “cannabis” is automatically interpreted as marijuana.  It’s not unusual for people encountering the word “cannabis” to wonder about psychoactivity and product legality. People tend to forget that hemp is also a cannabis plant.

The Extermination and Revival of Hemp Cultivation

Cannabis plants are considered the oldest domesticated crops in our history. Some cannabis plants were selectively bred for religious and medical purposes. As an herbal medication, cannabis was used for an extensive list of health issues. These were the marijuana plants. Other cannabis plants, hemp plants, were bred for food (hemp seeds), textiles, and rope. Same species, different purposes. Until the 1930s hemp was in high demand, and marijuana was legal. Then the tides turned.

  • As an effort to curb substance abuse, the government implemented the Marijuana Tax Act of 1937.1 The Tax Act imposed taxes on doctors and pharmacists for prescribing or selling cannabis. The government also imposed taxes on the cultivation of hemp. Taxation made hemp less economically viable and reduced the size of the hemp industry. The American Medical Association was opposed to the Marijuana Tax Act.2

 

  • President Nixon signed The Controlled Substance Act of 1970 and created the Drug Enforcement Administration (DEA).3 The new legislation established a list of banned drugs. The prohibited substances were referred to as schedule 1 drugs, substances with no accepted medical use and a high potential for abuse. Although hemp does not have psychoactive capabilities, the law specified cannabis. Under the Controlled Substance Act, it was no longer legal to grow hemp in the US, although hemp could be imported for industrial use.

 

  •  In 2013 the farming and cultivation of industrial hemp was legalized in Colorado. Thanks to the Agricultural Act of 2014 (the US Farm Bill), it is again legal to grow industrial hemp in 33 states. Today the differentiation between hemp and marijuana is clearly defined. As a result, hemp products can be shipped to all 50 states.

 

Non-Psychoactive Hemp Oil Supports the Endocannabinoid System  

Although cannabis may have fallen out of favor, researchers were still interested in the effects of cannabis on the brain. CBD was isolated from cannabis in the 1940s, and THC from CBD decades later. It was the investigation into the effects of CBD and THC that eventually led researchers to discover the endocannabinoid system.

Your endocannabinoid system is a network of messengers and receptors that regulate the way your body functions, the communication system between your body and brain. The cannabinoids in cannabis are exogenous cannabinoids, meaning cannabinoids from an outside source. Exogenous cannabinoids are found in CBD, the extract of hemp and marijuana plants.
